Welcome to My Adventour, a travel application operated by My Adventour App SL (“we,” “us,” or “our”), a company registered in Madrid, Spain. These Terms and Conditions (“Terms”) govern your access to and use of the My Adventour mobile application (“App”) and any related services. By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

You are solely responsible for any content you create, upload, or share within the App, including tours and photographs taken during tours. Before sharing any content with the community, you will be prompted to consent to such sharing.

You agree not to engage in any of the following prohibited activities:

  • Publishing or sharing content that promotes fascism, racism, sexism, or any form of discrimination.
  • Infringing upon any intellectual property rights or proprietary rights of others.
  • Sharing content that is unlawful, defamatory, obscene, or otherwise objectionable.
  • Attempting to interfere with the proper functioning of the App, including transmitting viruses or other harmful code.

Violations of these prohibitions may result in the suspension or termination of your account.

7. User-Generated Content

Content Creation and Sharing

You may create, save, and share tours with the community. By sharing content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, publish, and distribute such content within the App.

Ownership Rights

All shared content becomes the property of My Adventour App SL. You acknowledge that you have no expectation of compensation or attribution for the use of your content.

Consent for Sharing

You have the option to share or not share your tours upon completion. We do not require any license from you to display user content within the App.

8. Intellectual Property Rights

The App, including all content, features, and functionality, is owned by My Adventour App SL and is protected by Spanish and international copyright, trademark, patent, trade secret, and other intellectual property laws.

  • Trademarks: “My Adventour” and our logo are trademarks of My Adventour App SL. You must not use these marks without our prior written permission.

9. In-App Purchases and Payments

We offer in-app purchases and subscriptions for certain features. By making a purchase, you agree to the following terms:

By Company Decision

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms or engage in prohibited activities.

Procedure

Upon termination:

  • Your right to use the App will cease immediately.
  • We may delete your account and all associated content.
  • We are not liable for any loss of data or content resulting from termination.

13. Disclaimers and Limitation of Liability

AI-Generated Content

The App leverages Generative AI to provide personalized guided tours. While we strive for accuracy, the content, including prices and real-time information, may not always be accurate or up-to-date. You acknowledge that:

  • The content is provided “as is” without warranties of any kind.
  • You use the content at your own discretion and risk.

Limitation of Liability

To the fullest extent permitted by law, in no event shall My Adventour App SL or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages resulting from your access to or use of the App.
  • Unauthorized access, use, or alteration of your transmissions or content.

14. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Mediation

Any disputes arising out of or relating to these Terms or the App shall be resolved through mediation in Madrid, Spain. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Madrid.
